Jessica's extensive background in higher education and employment discrimination investigations has given her unique insights into workplace relationships and the complexities that come with them. She has specifically trained in neutral Title IX, VII, VI, ADA, and ADEA investigations and has a Juris Doctor from the University of Louisville Brandeis School of Law, a Master of Science degree in Leadership and Organizational Change from Regis College, and a Certificate in Local Government Management from Florida Gulf Coast University.

Workplace Harassment Mandates by State

Some employers hold the misconception that they are only obligated to provide sexual harassment training and other forms of workplace harassment prevention training to employees in states and local jurisdictions where specific statutes mandate such measures. However, this perspective overlooks broader legal considerations. Presently, several states and cities, including California, Connecticut, Delaware, Illinois, Maine, and New York, alongside locales like Chicago and New York City, have explicit statutes mandating sexual harassment training. Nevertheless, beyond these specific jurisdictions, a plethora of federal, state, and local laws, regulations, and judicial interpretations indicate a broader imperative for employers to furnish anti-harassment training to all employees nationwide. Among the states with statutes mandating or strongly encouraging training, Connecticut and Maine have historically required sexual harassment training, with Maine extending the mandate to cover all employees. Connecticut initially stipulated training solely for supervisors but later broadened the requirement to encompass all employees, with sessions lasting two hours for both employees and supervisors.

In California, the enactment of AB 1825 in 2005 initiated a mandate for two hours of sexual harassment training every two years for supervisors, a requirement later expanded by SB 1343 to include one hour of training every two years for non-supervisory employees. Similarly, Delaware mandates sexual harassment training every two years, mirroring the Californian model.
Furthermore, New York State and New York City have laws necessitating sexual harassment training for all employees annually. Illinois, through SB75, mandates annual sexual harassment training for all employees, while Chicago's requirements entail one hour of training annually for employees and two hours for supervisors, alongside an additional hour of bystander intervention training for both groups. Beyond these specific mandates, numerous other states, including Colorado, Florida, Hawaii, Iowa, Maryland, Massachusetts, Michigan, Ohio, Oklahoma, Rhode Island, Tennessee, Utah, Vermont, and Wisconsin, encourage employers to provide such training, reflecting a growing acknowledgment of the importance of fostering harassment-free workplaces across the nation.
